HEATING REGULATIONS
Landlords must provide
heat from October 1st through May 31st.
The requirements are as follows:
6 AM - 10 PM:
Heat must register at least 68 degrees (F)
when the outside temperature falls below
55 degrees (F);
10 PM - 6 AM:
Heat must register at least 55 degrees (F)
when the outside temperature falls below
40 degrees (F).
Hot water must be maintained
at a constant temperature of at least 120 degrees (F), 24 hours
a day, 365 days a year, to tenants in multiple dwellings (buildings
with 3 apartments or more) that are
at least 3 stories high and
to tenants living in garden type dwellings. The law requires landlords
of 1 and 2-family homes to provide hot water to tenants between
6 AM and 12 midnight minimally.
BOILER INSPECTIONS
Landlords who own a building
with six or more apartments, or a
building with fewer than
six apartments but with a boiler that also
services a store or other
commercial space, must get the boiler
inspected and file a report
with the NYC DOB (Department
of Buildings) by December
31, 2007.
The report must be at the
DOB at the close of business on that
day. If you are filling
by mail, be sure to mail the form in advance
to arrive at the DOB by December
31st. Owners who do not
comply with the inspection
and filing requirements can be fined
up to $5,000. If you
get your boiler inspected but do not file
the report by the December
31st deadline, the maximum fines
are $150 for a building with
more than six stories and $50 for
a building with six stories
or less.
